Privatstiftung

Founder

The person or persons who set up a private foundation and endow it with assets. Founder rights are strictly personal and only transferable to a limited extent.

In brief

Founders can be natural or legal persons. Only natural persons can reserve the right of revocation. Founder rights lapse on the death of the natural person founder unless the foundation declaration provides succession rules.

Where several founders act together they exercise reserved rights jointly in case of doubt. The declaration should provide majority or succession rules.
